Welcome to Etherea Fine Art. These Terms & Conditions apply to purchases of fine art prints and original physical artworks through www.etherearising,com, operated by Gabrielle Salvatore trading as Etherea.

By placing an order, you agree to these Terms & Conditions. Please read them carefully before purchasing.

1. About Etherea Fine Art

Etherea Fine Art presents original creative works and art prints inspired by mythology, nature, the divine feminine and the imagination.

2. Artwork and product descriptions

Each artwork listing will provide relevant information, which may include the artwork title, dimensions, materials, print medium, framing options, edition details and price.

Please check the individual product listing carefully before purchasing.

Digital images and colour variation

We aim to represent each artwork as accurately as possible. However, colours, contrast and fine details may appear differently depending on your screen, device settings, lighting and the materials used in production.

Product photographs and room mock-ups are illustrative only unless the listing expressly states that the pictured frame or accessories are included.

Minor variations in colour or finish may occur between print batches. Products will nevertheless be supplied in accordance with their description and applicable consumer guarantees.

Dimensions and framing

The product listing will specify whether an artwork is supplied framed or unframed. Frames, mounting hardware, installation and other accessories are included only where expressly stated.

Please confirm the dimensions and framing details before ordering, particularly for large-format artworks.

3. Fine art prints

Etherea fine art prints may be produced using professional printing services and specialist print partners.

Each listing will identify the available print size, substrate or material, finish, and framing options where applicable.

Production and print quality

Print production methods, materials, finishes and packaging may vary according to the selected product and print partner. We will describe the relevant specifications in the product listing.

Print editions

The edition status of each print will be stated on its product listing once finalised.

Etherea may offer open editions, limited editions or a combination of both. A limited edition will identify its edition size and, where applicable, the numbering and authentication arrangements.

A print will not be advertised as limited edition unless its edition details have been established and can be honoured.

4. Original physical artworks

Original artworks are distinct physical works and may differ from prints in their materials, dimensions, presentation and availability.

Each original artwork listing will identify its relevant details, including whether the work is framed, unframed, ready to hang or supplied with a certificate of authenticity.

Unless expressly stated otherwise, the purchase of an original artwork transfers ownership of the physical artwork only. It does not transfer copyright or other intellectual property rights.

Availability of original works is subject to the individual listing. Once an original artwork has been sold, it will not be offered as available again unless the listing clearly relates to a different work.

5. Pricing and payment

All prices will be displayed in Australian dollars (AUD) unless otherwise stated.

Applicable taxes and delivery charges will be disclosed during checkout or before the order is finalised.

Available payment methods will be displayed at checkout.

Please check your order details carefully before completing payment. Etherea reserves the right to correct genuine pricing or listing errors before accepting an order. If an error affects an order already placed, we will contact you to discuss an appropriate resolution.

An order is accepted when [insert confirmation process, such as written order confirmation]. An order confirmation does not limit any rights you may have under Australian Consumer Law.

6. Production, dispatch and delivery

Some prints may be produced to order rather than held in stock. Original artworks may require separate handling or specialist packaging.

Estimated production and delivery timeframes will be displayed on the relevant product listing or communicated before purchase where possible.

Delivery estimates are provided in good faith but may be affected by circumstances outside our reasonable control, including carrier delays, production interruptions and severe weather. If a significant delay arises, we will communicate with you and work towards an appropriate resolution.

Please ensure your delivery address and contact details are correct when placing your order.

Responsibility for arranging a remedy for goods that are lost or damaged in transit will be handled in accordance with the applicable consumer guarantees and other relevant law.

Large or specialist deliveries

Large-format prints and original artworks may require specialist carriers, additional packaging or delivery arrangements. Any additional charges and material delivery conditions will be disclosed before you complete your purchase.

Installation, hanging, customs duties and import charges are not included unless expressly stated.

7. Damaged, faulty or incorrect orders

We take care to ensure that artworks are properly produced, checked and packaged.

If your order arrives damaged, faulty, materially different from its description or incorrect, please contact us at [insert email] with your order number and a description of the issue. Photographs of the artwork and packaging may help us assess the problem.

Where reasonably possible, please contact us promptly after discovering the issue so that we can investigate and coordinate with the relevant print partner or delivery service.

We will assess the issue and provide the remedy required under Australian Consumer Law. Depending on the circumstances and the nature of the failure, this may include a repair, replacement, refund or other remedy.

You do not lose your statutory rights because a print was made to order, because packaging has been opened, or because a particular reporting period has passed.

8. Change of mind, cancellations and returns

Please choose your artwork and specifications carefully before ordering.

We do not promise change-of-mind refunds or exchanges unless a separate policy or product listing expressly provides them.

If a change-of-mind policy is offered, its conditions will be disclosed before purchase.

If you wish to cancel an order before production or dispatch, contact us as soon as possible. We will advise whether cancellation is possible, taking into account the stage of production, any applicable agreement and your legal rights.

Custom, personalised or made-to-order products may have different practical cancellation arrangements. However, these arrangements do not exclude or restrict rights available under Australian Consumer Law.

Nothing in this section limits a customer's rights to a remedy where required by law.

9. Copyright and intellectual property

All artwork images, designs, compositions, digital files, written content, branding and other creative material displayed by Etherea remain the property of their respective rights holders unless otherwise stated.

Purchasing a print or original physical artwork does not transfer copyright.

Unless we give express written permission, purchasers may not:

• Reproduce, scan, photograph for commercial reproduction, copy or distribute the artwork for commercial purposes.

• Create merchandise, derivative products or other reproductions using the artwork.

• Sell, license, publish or distribute digital copies of the artwork.

• Use the artwork in advertising, branding, commercial interiors or other commercial projects beyond the rights expressly granted.

• Remove or alter copyright notices or ownership information.

Purchasers may display their purchased physical artwork for personal enjoyment, subject to applicable law and any specific licence agreed in writing.

Commercial display, reproduction, licensing, publication or other commercial use requires separate written permission unless expressly included in the purchase agreement.

Etherea will describe any additional usage rights offered with a particular artwork in its listing or a separate written licence.

10. Authenticity and certificates

Where a certificate of authenticity is offered, the product listing will state this.

Certificates, signatures, edition numbers and provenance details will only be represented as applicable to the particular artwork.

Etherea will not describe a print as signed, numbered, certified or part of a limited edition unless that description accurately reflects the product being supplied.

11. Privacy and order information

Personal information collected through an order will be handled in accordance with our [Privacy Policy].

Information may need to be shared with payment processors, printing partners, fulfilment providers or delivery services to process and deliver your order.

12. Australian Consumer Law

Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Your rights and the remedy available depend on the nature of the product and the circumstances of the issue.

13. Limitation of liability

To the extent permitted by law, Etherea is not responsible for loss arising from circumstances beyond our reasonable control.

Nothing in these Terms & Conditions excludes liability or limits any remedy where doing so would be unlawful, including rights and remedies arising under Australian Consumer Law.

14. Changes to these Terms & Conditions

We may update these Terms & Conditions from time to time. The version published on our website will include its latest update date.

Changes will apply to future orders. Any changes affecting an existing order will be handled in accordance with the agreement applicable to that order and relevant law.

15. Governing law

These Terms & Conditions are governed by the laws applicable in Victoria, Australia, and the applicable laws of the Commonwealth of Australia.

Any dispute will be dealt with in accordance with applicable law, including any mandatory consumer protections.
